This class is aimed at students seeking to understand the dynamic and evolving nature of the Constitution. Students will learn the procedure of constitutional amendments under Article 368, with emphasis on the basic structure doctrine established in Kesavananda Bharati. The class will also address contemporary constitutional challenges, including constitutional morality, affirmative action and reservations, electoral reforms, and judicial independence. Real-life debates such as the Uniform Civil Code, reservation in promotions, and the role of technology in elections will be incorporated into discussions.
Students should bring the bare act and keep abreast of recent constitutional amendments and Supreme Court judgments through newspapers and legal databases. By the end of this class, they will be able to appreciate the Constitution as a living document, capable of adapting to new social, political, and technological realities while safeguarding its foundational principles.
